New Trial for Kelly Lumadue

DELTONA - A 32-year-old Deltona woman convicted last month of having sex with a 5-year-old boy won a new trial Wednesday.I blogged about Lumadue previously here. Even if coerced or abused, what Kelly Lumadue did is still a crime in my opinion. Making excuses for abusing others, shouldn't let you off the hook for what you did.
Circuit Judge Clayton Simmons ruled that because of a variety of issues, including overly aggressive questioning by a prosecutor, Kelly Lumadue was entitled to a new trial.
Lumadue was convicted June 15 of capital sexual battery and sentenced to life in prison after prosecutors played for jurors videotapes made by her husband that showed her having sex with the child.
Lumadue was 19 at the time, and her husband was a professional pornographer, according to court records.
Defense attorney James "Tad" Figgatt said Lumadue's husband coerced and physically abused her.
The boy did not testify. Figgatt said the child, now a teenager, does not remember the incidents.
